Allahabad High Court Terms Triple Talaq Unconstitutional

The Allahabad high court on Thursday termed the Islamic practice of divorcing a woman by uttering the word “talaq” thrice as unconstitutional. The high court stated that the triple talaq practice violated the rights of Muslim women. The court emphasised tha no ‘Personal Law Board’ cannot be above the Constitution.

The issue of triple talaq has been taken to the Supreme Court by several women with the central government has told the top court that the practice is against gender justice and the Constitution.

The influential All India Muslim personal law board has defended the practice, saying it is better to divorce a woman than kill her. The rights bestowed by religion can’t be questioned in a court of law, it has said.
