Man Who Was Arrested For Bursting Firecrackers During Diwali, Now Convicted By Delhi Court

A Delhi resident who was arrested for bursting firecrackers in the national capital after the permissible time limit of 10 PM has now been convicted for the ‘crime’ by a local Delhi court, Live Law has reported.

The accused Mayank Singh was convicted by the Additional Chief Metropolitan Magistrate Jitendra Singh for the incident which took place on 7 November 2018.

Mayank was bursting crackers in Paharganj after which he was ordered by a police patrol on duty to refrain from the activity. The police patrol then left for an emergency call and when they returned found that he was still bursting crackers.

As a result, the cops then booked him under Section 188 CrPC for disobeying them. In his defence Mayank claimed that he was not aware of the Supreme Court order which had placed a limit on bursting crackers.

Under the judgement, the Additional Chief Metropolitan Magistrate noted that nothing substantial in favour of the accused had been recorded during the cross-examination and that the prosecution had successfully proven that he had violated the Supreme Court judgement.

After the conviction, the judge observed that Mayank had a clean record and thus let him off with an admonition. He was also asked to pay Rs 500 as cost of proceedings.
