Eminent Jurists Ask Justice Joseph To ‘Prove’ Allegations Against Former CJI Misra, With Concrete Evidence

Commenting on Justice Kurian Joseph’s allegations against former chief justice of India Dipak Misra - that the latter was being ‘remote controlled’ by some external source - a former chief justice of India has stated that it is for Justice Joseph to explain the basis for his allegations, reports The New Indian Express.
Former solicitor-general Mohan Parasaran reiterated similar views, stating that Justice Joseph should present “evidence” for his charge.
Joseph had alleged on Monday (3 December 2018) that Misra had acted under “external political pressure” and was allotting cases to judges based on perceived political biases.
Speaking about the allegations, another former chief justice of India stated, "I would not like to comment and it would also not be appropriate for me to comment. Ask the person who made those comments and he against whom the comments were made.”
The ex-CJI reposed his faith in the judiciary, stating that an individual’s statement could not be interpreted to mean the “crumbling down” of the entire institution. He recounted how eminent judges of the Supreme Court had acted independently in the past, in the face of external pressure.
Mohan Parasaran also said the views of justice Joseph were “personal” and that he needed to come out with some “evidence” to back up his claims. He noted that Justice Misra was a “disciplinarian” and would take whatever corrective course was required.
One being questioned over the possibility of an inquiry over Justice Joseph’s charges, Parasaran expressed scepticism, saying, "It is a case of washing dirty linen in public. Who is going to do that," he said.
