The law which criminalised adultery dates back to 150 years. Now, thanks to the Supreme Court of India, the legislation, which was seen as commodifying women, has now been declared null and void. However, All India Majlis-E-Ittehadul Muslimeen (AIMIM) President Asaduddin Owaisi has demanded that the Centre take back its ‘unconstitutional ordinance’ on Triple Talaq.

A five-judge Constitution bench headed by Chief Justice of India Dipak Misra, Justice RF Nariman, Justice AM Khanwilkar, Justice DY Chandrachud and Justice Indu Malhotra ruled the judgement, reported Financial Express.

ANI quoted Owaisi as saying, “My opinion is that Triple Talaq ordinance should be challenged in court because it’s a fraud. In the first page of the ordinance, the government says the Supreme Court has termed it unconstitutional, but the SC didn’t say any such thing. Rather, it just set it aside.”

The ordinance on the Triple Talaq Bill was approved by the Union Council of Ministers on 19 September 2018. Outraged by this move, Owaisi termed it ‘unconstitutional’ and ‘anti-women’.

He also urged the All India Muslim Personal Law Board (AIMPLB) to challenge the judgement in the Supreme Court. Due to the failure of the BJP government to table the bill during the Monsoon session in Rajya Sabha, they had to approve an ordinance.
