Constitution Bench Of Supreme Court To Hear Petitions Challenging Abrogation Of Article 370 From 2 August

The petitions challenging Article 370 of the Constitution was heard today (11 July) by the Supreme Court.

A five-judge Constitution bench of the Supreme Court has been directed to start hearing the matter from 2 August on day-to-day basis, except on Mondays and Fridays.

The parties have been directed by the bench comprising of Chief Justice of India D Y Chandrachud and Justices SK Kaul, Sanjiv Khanna, BR Gavai and Surya Kant, to file all the documents, compilations and written submissions by 27 July.

Additionally, the Solicitor General has submitted that though the Centre has filed an additional affidavit setting out central government’s view on the post-notification development, it would have no bearing on the constitutional question and it would not be relied upon.

In other words, the benefits of the Article 370 being rendered infructuous, as described by the Centre, would have no bearing on the hearing.

Moreover, two petitioners Shah Faesal and Shehla Rashid sought permission of the court to withdraw their pleas and the request was allowed.
