The Supreme Court on Wednesday (21 May) nullified a writ petition filed by a few advocates seeking registration of an FIR to investigate Justice Yashwant Varma with regard to the in-house inquiry into the accusations of recovery of illicit cash currencies from his official residence.

According to a bench consisting of Justices Abhay Oka and Ujjal Bhuyan, the Chief Justice of India (CJI) has already forwarded the in-house inquiry committee's report and Justice Varma's response to the Prime Minister and President.

“You do not know the contents of the report. We also do not know the contents of that report. You make a representation calling upon them to take action. If they do not take action, then you can come here,” the bench said.

Nedumpara said he was asking for reconsideration of the 1991 ruling in K Veeraswami vs Union of India, wherein it was decided that filing a criminal case under Section 154 of the Criminal Procedure Code against a sitting high court or Supreme Court judge requires the CJI's prior approval. But the court said the prayer need not be considered now.
