Article 370: Justice Kaul Suggests Constituting Truth And Reconciliation Committee To Look Into Human Rights violation In A Separate order

In a separate ruling during the hearing on the scrapping of Article 370 in Jammu and Kashmir, Justice Sanjay Kishan Kaul advocated for an impartial investigation into human rights abuses in the region dating back to the 1980s.
Justice Kaul recommended the establishment of a Truth and Reconciliation committee and report on the violations of human rights both by the state and non-state actors, emphasising the need for reconciliation measures.
"To move forward, wounds require healing. Intergenerational trauma is felt by people. The first step towards healing the wounds is the acknowledgment of the acts of violations done by the state and its actors," stated Justice Kaul during the hearing, as reported by NDTV.
While emphasising the original intent of Article 370, Justice Kaul noted that its purpose was to gradually integrate Jammu and Kashmir into India.
He highlighted the necessity of respecting the requirement for the recommendation of the Jammu and Kashmir Constituent Assembly, stating that it cannot be interpreted in a way that renders the larger intention redundant.
Concerns were also raised by Justice Kaul regarding the use of "backdoor amendments" to bypass established procedures for Article 370.
Earlier, The Supreme Court, in today's (11 December) verdict had validated the government's decision to scrap Article 370, which conferred special status upon the erstwhile state of Jammu and Kashmir.
