'Lord Krishna's Birthplace Lies Beneath The Mosque': Plea In Allahabad HC To Appoint Commission For Mathura Janmabhoomi Site Inspection

In a notable development concerning the Mathura's Krishna Janmabhoomi-Shahi Eidgah Mosque dispute, an application has been submitted in the Allahabad High Court requesting the appointment of a court commissioner to inspect the mosque.
As reported by Livelaw, acknowledging the application, a bench presided by Justice Mayank Kumar Jain on 7 November granted the defendants, including the Uttar Pradesh Sunni Central Waqf Board, the opportunity to file their objections.
Filed under Order 26 Rule 9 CPC, the application is on behalf of the deity (Bhagwan Shri Krishna Virajman) and seven others, represented by advocates Hari Shankar Jain, Vishnu Shankar Jain, Prabhash Pandey, and Devki Nandan.
It asserts that Lord Krishna's birthplace lies beneath the mosque and provides numerous indicators to support the claim that the mosque was originally a Hindu temple.
The application highlights the presence of a lotus-shaped pillar, a characteristic feature of Hindu temples, and an image of Sheshnaag, a Hindu deity who protected Lord Krishna on the night of his birth.
Additionally, it notes the presence of Hindu religious symbols and engravings at the base of the mosque's pillar.
Against this backdrop, the application implores the Allahabad High Court to appoint a commission comprising three advocates and instruct them to submit a detailed report.
Furthermore, the application requests permission for photography and videography during the entire process. This application has been presented in the context of the ongoing original suit in the high court.
The suit seeks a declaration that the disputed land, including the area occupied by the Shahi Idgah Mosque, belongs to the deity, Bhagwan Shri Krishna Virajman.
It further urges the defendants, including the Uttar Pradesh Sunni Central Waqf Board, to remove the mosque.
The suit contends that Mathura's Shahi Idgah mosque was constructed under the orders of Emperor Aurangzeb, adjacent to the Krishna Janmabhoomi, the revered birthplace of Lord Krishna, after the demolition of a Hindu temple.
Recently, the high court dismissed a public interest litigation seeking the recognition of the disputed site as Krishna Janmabhoomi and the removal of the mosque.
The court noted that several suits addressing declaration, injunction, the right to worship at the site, and the removal of the structure were already under consideration.
