Swati Maliwal Assault Case: Delhi Court Reserves Order On Bibhav Kumar's Bail, Here's What Was Argued

While Delhi's Tis Hazari court reserved its judgment on Chief Minister Arvind Kejriwal's personal secretary Bibhav Kumar's bail plea in the Swati Maliwal assault case, the AAP Rajya Sabha MP broke down in the court.

These were the broad topics that the arguments covered today (27 May):

1. Trespass: Kumar's counsel, Advocate Hariharan argued that Maliwal entered the CM's residence without any appointment and hence report alleging trespass was filed against her.

Additional Public Prosecuter (APP) argued that Maliwal was allowed to sit in the waiting room that implies permission and hence allegations of trespass are false.

2. Assault: Hariharan argued that there is no grievous injury on any vital part and hence there is no question of culpable homicide not amounting to murder. He even alleged that the injuries can be self-inflicted.

The accused had beaten a lady who was alone, dragged her and her head hit the centre table, will this not cause a death, the APP argued adding that even after days of the incident, the bruises confirmed assault.

3. Evidence tampering: The APP argued that the accused should not be released on bail as he is influential and can tamper the evidence, while the defence said that the police has already seized DVR and there is no evidence of tampering CCTV.

The APP argued that Kumar's phone was formatted which amounts to tampering. The accused was also taken to Mumbai, where he allegedly formatted his phone.

4. Threats: Citing rape and death threats being received by Swati Maliwal as AAP has a "huge troll machinery", her counsel Khurana argued that Kumar out on bail will be a threat to her and her family.
