The Supreme Court bench of Justices V Ramasubramanian and Pankaj Mittal reserved its order in the appeal filed by the Tamil Nadu government against a judgement of the Division Bench of the Madras High Court which allowed the Rashtriya Swayamsevak Sangh (RSS) to conduct its route marches.

The Division Bench had said that conducting peaceful public processions is a part of the ‘freedom of speech.’

Earlier, a single-judge bench of the Madras High Court had ordered the RSS to conduct its route marches within a closed compound such as a stadium.

The state had appealed against the order of the Division Bench citing issues of law and order and threats to the march from organisations like the Popular Front of India (PFI).

During the last hearing on 17 March, it cited the panic created among migrant workers due to fake videos to ask the Court for a rethink.

Advocate Mahesh Jethmalani, who appeared for the RSS argued that peaceful marches of an organisation should not be stopped due to threats and it was the state’s responsibility to ensure law and order. He added that the PFI is already banned.
