WTM EP119: The story of pending cases in courts

The total number of pending cases in courts now exceeds 5 crore. The government — being the largest litigant — is responsible for 50 percent of these cases, and 85 percent of all pending cases are concentrated in district courts alone.

This raises a crucial question: why is the government, the very entity tasked with strengthening the judicial system, also straining its resources?

  • Do our courts have the capacity to efficiently dispose of these cases?

  • While there are over 5,000 vacancies for judges in lower courts, why do the state governments or the higher courts put a stay on recruitment of civil judges in the state?


  • In the latest episode of What This Means we discuss with Nikhil Mehra, a Supreme Court lawyer, and Abhishek Dwivedi, a lawyer practising before the Lucknow Bench of the Allahabad High Court, the various problems facing the courts in fast-tracking the huge pile of pending cases and the solutions for them.

    On the bright side, there's a silver lining: for the first time last year, the disposal rate of cases outpaced the filing rate — a trend that continued this year. Just last month, 22 lakh cases were filed, while 31 lakh were disposed of.
