Supreme Court Delivers A Split Verdict In Hijab Case

A division bench of the Supreme Court has delivered a split verdict in the batch of petitions challenging the Karnataka HC judgement which upheld the government’s order banning the wearing of hijab in education institutions.

While, the presiding Judge, Justice Hemant Gupta, dismissed the appeals upholding the Karnataka HC Judgement, Justice Sudhanshu Dhulia set aside the Karnataka HC judgement and quashed the ban on hijab.

The judgement was reserved by the bench on 22 September, after hearing the parties for 10 days consecutively.

On 15 March, the Karnataka HC delivered its verdict, concluding that Hijab is not an essential part of Islam and thus could not be protected under the fundamental right.
