Centre, Law Commission Get Delhi HC’s Notice On PIL Seeking Drafting Of Uniform Civil Code

The Delhi High Court on Friday (31 May) issued notice on a public interest litigation (PIL) seeking direction to Centre to draft a Uniform Civil Code to promote fraternity, unity and national integration.
A Division bench of Chief Justice Rajendra Menon and Justice Brijesh Sethi also issued notice to Law Commission of India on the petition filed by BJP Leader Ashwini Upadhyay, reports Live Law.
The petitioner submited that while the Constitution guarantees freedom of conscience and of religion, it seeks to divest religion from personal law and social relations and from laws governing inheritance, succession and marriage, just as it has been done even in the Muslim Countries like Turkey and Egypt etc,
In the petition, Upadhyay said that the objective of the Article 44 is to introduce a Uniform Civil Code, which is essential to promote fraternity, unity and national integration.
The petition further added that several enactments have been made by the Parliament since Independence in the name of Hindu code. However, these enactments only relate to Hindus (including Buddhists, Jains and Sikhs) and excludes the Muslims, who are the major slice of the minority communities.
