‘Give Us Details Of The Decision Making Process In Rafale Deal’: Supreme Court Asks Modi Government

The Supreme Court today (10 October) sought from the government details of the decision-making process in the Rafale Deal while hearing a petition that sought suspension of the deal, Mint has reported. The SC bench said that it would not look into the issue of pricing. It also refused to issue a notice to the central government.
“We have not taken into account the averments made in the writ petition and this is only to satisfy ourselves,” Chief Justice Ranjan Gogoi said. The attorney general KK Venugopal argued that the petition filed in the Rafale case was political in nature and was not in the public interest. Further, he added that courts should not look into the matter since it was not a judicially reviewable matter.
The petition filed by advocate M L Sharma alleged discrepancies in the fighter jet deal. Sharma sought quashing of the inter-government agreement on grounds it was not ratified by Parliament. He claimed that under Article 253 of the constitution, the Parliament had to make a law for implementing any inter-government agreement.
