In a big development, the Supreme Court bench has said that the Babri mosque wasn’t built on a vacant land, and agreed with the ASI findings that there was a Hindu-structure beneath the mosque.

However, the court also said that the ASI report didn’t state that the mosque was built after demolishing a temple. The court also said that the title of the land can be decided only on legal evidence.

Mere existence of a structure beneath the mosque cannot lead to a title today even if the SC finds that it was a Hindu temple, SC says. This hints at the fact that the court may discount the faith of the Hindus as far as the legal ownership of the Janmabhoomi is considered.

The court also wondered whether belief and faith is justified is beyond the ken of judicial scrutiny. It mentioned that the accounts of the travellers that mention the Ram Temple have to be taken with “circumspection”.

It also said that faith and belief of Ayodhya being birthplace of Ram is undisputed so is that of Muslims to worship at the mosque.
