SC Says It Can’t Dismantle Collegium System

A Supreme Court bench comprising Justice Arun Mishra and Justice Uday Umesh Lalit rejected a plea that sought to set up an independent body to select judges.

While dismissing the plea filed by the National Lawyers Campaign for Judicial Transparency, the bench said that doing so would be akin to amending the Constitution, which the Supreme Court could not do.

The petition sought an independent, fair and open process to select judges and argued that under the current procedure, judges’ relatives were being inducted into the higher judiciary.

During the hearing, the bench asked the counsel if he was addressing the court or the media who were seated in the gallery when the counsel’s pitch reportedly became too high while making the argument.
