The Law Commission recommended today that gambling and betting on sports be allowed as regulated activities taxable under the direct and indirect tax nets, according to this report in the Economic Times. These recommendations are part of the commission’s report titled, ‘Legal Framework: Gambling and Sports Betting including Cricket in India’.

Regarding legislating for the same, the report states that ‘Parliament may also enact a model law for regulating gambling that may be adopted by the states or in the alternative, Parliament may legislate in exercise of its powers under Articles 249 or 252 of the Constitution’.

The Law Commission has also recommended linking the Aadhaar card or PAN of the people participating to the betting/gambling process. In addition, it has advised that the transactions be cashless. These suggestions were made with the intention of preventing illegal activities, including money laundering.
