The petitioner in the defamation case against Rahul Gandhi, Gujarat BJP Leader Purnesh Modi, has requested the Supreme Court to dismiss the Congress leader's appeal against conviction.

The petitioner argues that Rahul Gandhi defamed all individuals with the surname Modi, particularly those from Gujarat's 'Modh Vanik' caste.

Purnesh Modi further stated that Rahul's statement displayed an arrogant sense of entitlement and was motivated by personal hatred towards the elected Prime Minister of the country.

In his plea to the court, the BJP MLA from Gujarat urged against staying Rahul's conviction. He claimed that the level of hatred towards the Prime Minister was so extreme that Rahul was compelled to make highly defamatory remarks about individuals who happened to share the same surname.

He argued that stays of conviction are only granted in exceptional cases, and Rahul's situation does not fall into that category.

Purnesh Modi emphasized that the trial court's conviction order is unquestionable based on the evidence presented during the trial.

The Gujarat MLA claimed that Rahul's statement revealed arrogance, insensitivity, and contempt for the law. He accused Rahul of using scurrilous words against a large group of people who have caused no harm to him.

The Supreme Court has issued notice on Rahul Gandhi's appeal against the Gujarat High Court's verdict.

The next hearing is scheduled for August 4.

Rahul Gandhi was disqualified as a Member of Parliament after being convicted and sentenced to two years in prison for criminal defamation.

The charges stemmed from comments he made about the Modi surname during a rally in Karnataka before the 2019 Lok Sabha elections.
