Mahua Moitra Vacates Official Residence After Delhi HC Dismisses Her Plea To Stay Eviction Proceedings

The Centre has reportedly started the eviction drive at the official residence of Trinamool Congress leader and former Lok Sabha MP Mahua Moitra.

This comes as the Delhi High Court on Thursday (18 January) dismissed her plea for a stay on eviction proceedings.

However, Moitra's lawyer claimed that the residence was vacated before the eviction drive began.

"House number 9B on Telegraph Lane occupied by Mahua Moitra was vacated by 10 am this morning before the authorities arrived. No eviction took place," Moitra's Counsel Shadan Farasat was quoted as saying by news agency PTI.

According to the reports, a team of officials of the Directorate of Estates under the Union Ministry of Housing and Urban Affairs began an eviction drive at Moitra’s official residence on Friday (19 January) morning.

The eviction drive was initiated at 9B, Telegraph Lane, the house that had been allotted to Moitra while she was a Lok Sabha MP, Indian Express reported citing ministry sources.

Moitra was expelled from the Lok Sabha on 8 December after the Ethics Committee found her conduct “unethical”.

She was accused of raising questions in Parliament on behalf of businessman Darshan Hiranandani. However, the TMC leader had denied the allegations.

The Directorate of Estates had issued her a notice of eviction on 8 January , as per the Public Premises (Eviction of Unauthorised Occupants) Act, 1971.

As per the Act, the allottee of residential accommodation has one month to vacate the premises after becoming ineligible.

Then, an eviction notice is issued if the allottee has not vacated the house within a month, giving time of three days to respond.

After giving time for a hearing, the estate officer issues an order of eviction, following which the eviction is carried out.
