Delhi HC Directs Twitter To Take Down Five More Tweets By Audrey Truschke Against Historian Vikram Sampath

The Delhi High Court on Wednesday (4 May) directed Twitter to take down five more defamatory tweets by Audrey Truschke against historian Vikram Sampath.

Trusche, in the said tweets, had alleged plagiarism by Sampath in relation to his works on Veer Savarkar.

Earlier in February too, the Court had ordered the micro-blogging website to take down five tweets by Truschke against Sampath.

"In my view, the tweets with regard to the subject matter of the present application are defamatory in nature and there is a link posted in the said tweets to the very same letters, the publication of which was injuncted by this Court vide orders dated 18th February, 2022 and 24th February, 2022," the single-judge bench of Justice Amit Bansal said in the order.

The order was passed by court on an application filed on behalf of Sampath, seeking a direction for taking down of further defamatory tweets posted by Truschke, reports Live Law.

In his plea, Sampath had also sought permanent injunction on publication of the letter dated 11 February written by Truschke, Ananya Chakravarti and Rohit Chopra to Britain's Royal Historical Society (RHS) President Emma Griffin, raising serious allegations of plagiarism.

Noting that Truschke had failed to enter appearance before the Court, the Bench was of the view that a prima facie case is made out on behalf of Sampath.

In view of the fact that Truschke has not submitted to the jurisdiction of this Court and is not appearing in these proceedings, the Court directed Twitter to take down five tweets posted by Truschke.

The matter will now be heard on 28 July.
