Office Of Profit Case Against Governor RN Ravi Dismissed By Madras High Court

The Madras High Court has dismissed a quo warranto writ petition filed against Tamil Nadu Governor RN Ravi.

The petitioner M Kannadasan, who is the president of the Kanchipuram unit of the Thanthai Periyar Dravidar Kazhagam (TPDK) had filed the petition asking the High Court to issue notice to Ravi asking him as to under what authority was he holding the office of Governor when he was also holding an 'office of profit' as the Chairman of the Board of Governors of the Auroville Foundation.

As per the constitution, under Article 158(2), a Governor shall not hold any other office of profit.

According to Kannadasan, it was clearly a case of office of profit because the position comes with salary, allowances and service conditions such as leave, pension, provident fund etc.

The Division Bench of the High Court ruled that a writ petition against the Governor could not be entertained in view of the immunity provided under Article 361 of the Constitution.
