A bench of Justices UU Lalit, Aniruddha Bose and Sudhanshu Dhulia of the Supreme Court granted bail to Varavara Rao on medical grounds. Rao is one of the accused in the Bhima Koregaon case.
The bench observed that the matter has not been taken up for framing of charges and the discharge applications also stand pending. Moreover, as the medical condition of Rao had not improved, he was entitled to bail on purely medical grounds. He has been directed to not leave the jurisdiction of Mumbai city. Additionally, if Rao is found to violate his bail conditions, the bail would be set aside.
The bench, while granting him bail, deleted the paragraph wherein the Bombay High Court had granted bail to Rao for a three-month period.
The Court made it categorically clear that the bail order would not impact any other accused in the case or Rao’s case on merits.
SV Raju, Additional Solicitor General of India, countering Rao’s bail application, argued that Rao was a member of CPI (Maoist) which is a banned organisation and has engaged in nefarious activities, due to which he was denied bail.
