The Division Bench of Madras High Court comprising Justices J Nisha Banu and D Bharatha Chakravarthy is likely to decide the date on which the Enforcement Directorate (ED) could take minister Senthil Balaji into custody.
The matter has come to the Division Bench because Justice CV Karthikeyan, who heard the habeas corpus plea after a split verdict, said that the date would have to be decided by it.
The verdict of the Madras High Court was challenged by Balaji in the Supreme Court, which adjourned the matter to 26 July after a hearing on 21 July.
Senior Advocate Kapil Sibal, appearing for Balaji had requested the Court to grant interim protection from police custody given that the Division Bench of the Madras High Court was set to decide the date of custody.
However, the bench did not grant the request. Justice AS Bopanna had said that nothing would happen and the matter would be heard again on 26 July at 2 PM.
