Kerala HC Dismisses State Govt's Writ Petition Regarding Inclusion Of Christian Nadar Community In OBC Category

Chief Minister Pinarayi Vijayan-led Kerala state government’s writ petition challenging the single judge ruling which stayed their decision to include the Christian Nadar community in the Other Backward Castes (OBC) category has been dismissed by the state High Court (HC).

Kerala HC Chief Justice S Manikumar along with Justice P Chaly comprised the division bench that dismissed this appeal, ANI reports.

On the other hand, prior to this, the single-judge bench had observed that only the President of the country held the right to expand the list of communities to be included in the OBC category and hence stayed the aforementioned order of the state government.

In fact, the judge also drew parallels from the Supreme Court’s judgement in the Maratha reservation case recently.

It observed that the Kerala government’s order considering the Christian Nadir community to belong to the OBC category went against the spirit of the apex court’s verdict in the Maratha reservation mater.

The division bench then expressed that it did not find any merit in the arguments put forward by the appellants. It hence dismissed the appeal and affirmed that the single judge bench has elaborately decided on this issue, Live Law reports.
