PM, CMs, Ministers In Custody For 30 Days To Face Automatic Removal: Shah To Table Bills In Parliament Today

The central government is set to introduce three bills in the Lok Sabha today (20 August) to establish a mechanism for the removal of the Prime Minister, Union ministers, Chief Ministers, and state ministers if arrested and detained for 30 consecutive days on serious criminal charges.

The bills specify that such removal applies to offences punishable with imprisonment of at least five years.

Union Home Minister Amit Shah will move the Constitution (One Hundred and Thirtieth Amendment) Bill, 2025, which amends Articles 75, 164, and 239AA of the Constitution.

This bill requires the Prime Minister or any Union minister to resign or be automatically removed on the 31st day of continuous custody.

Similar provisions extend to Chief Ministers and state ministers.

The Government of Union Territories (Amendment) Bill, 2025, applies the same rules to ministers in Union Territories such as Delhi and Puducherry. The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025, incorporates these measures for Jammu and Kashmir.

A government statement confirmed that the bills address cases where leaders are held for grave offences, including murder and large-scale corruption.

Currently, removal occurs only upon conviction, as per existing constitutional provisions.

Shah may also move a motion to refer the three bills to a joint committee of Parliament for further review.

The ‘List of Government Business on August 20 and 21’ in the Lok Sabha includes the introduction of the following Bills:

(i) The Constitution (One Hundred and Thirtieth Amendment) Bill, 2025;

(ii) The Government of Union Territories (Amendment) Bill, 2025;

(iii) The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025;

(iv) The Promotion and Regulation of Online Gaming Bill, 2025.

Opposition parties scheduled a meeting on 20 August, to discuss the bills.
